Advanced ADR workshop to be presented by speakers from Nominet UK and WIPO over 2 days in Sandton, Johannesburg. Attendance is compulsory for all Adjudicators and there is also limited space available to the public.
The SAIIPL, UniForum SA and the .ZA Domain Name Authority will host senior speakers from Nominet UK and WIPO (World Intellectual Property Organisation) in presenting an Advanced Alternate Dispute Resolution (ADR) workshop in Johannesburg. The ADR workshop, which coincides with iWeek, will take place on the 3rd and 4th of September 2007 at the offices of Bowman Gilfillan in Sandton. All ADR Adjudicators are compelled to attend the workshop and there is also limited space available for the public who have an active interest in the workings of the .ZA ADR Regulations.
The workshop will run over two days and will predominantly focus on the substantive legal issues influencing international domain name ADR Decisions, in particular the UDRP (Uniform Dispute Resolution Policy) and the Nominet DRS (Dispute Resolution System).
Senior speakers from Nominet UK (the .uk domain name Registry) and WIPO (a dispute resolution provider in terms of the ICANN UDRP and many other ccTLD dispute resolution systems) will present an advanced ADR workshop over 2 days. The first day will deal with substantive and procedural issues identified through WIPO decisions and the second day with substantive issues identified and dealt with through the Nominet DRS, which includes a compulsory mediation phase.
The benefit of this workshop should be self-evident, as domain name dispute resolution procedures around the world have evolved on common international legal principles and practices. Many administrative and substantive problems faced by European and US domain name ADR systems have, or will, present themselves to South African domain name experts.
South Africans can only benefit from the experiences of large successful ADR providers such as WIPO and Nominet. In doing so we can spare ourselves many of the challenges that have already been resolved elsewhere, and rather focus on the challenges that are unique to South African. An example being Offensive Registrations.
The workshop is compulsory for all ADR Adjudicators, and will be of benefit to legal and corporate counsel, who have a significant interest in the application of the .ZA ADR Regulations.
SPEAKERS
NICK WENBAN-SMITH (SENIOR LEGAL COUNSEL) NOMINET
Following his degree in Natural Sciences at Cambridge University, Nick completed legal training in the City of London and qualified as a Solicitor of the Supreme Court of England and Wales in 1997. Nick specialises in corporate and commercial law and is currently Senior Legal Counsel at Nominet UK, a role which includes the leadership and management of Nominet's Dispute Resolution Service.Prior to joining Nominet, Nick held senior in-house legal positions at PowderJect Pharmaceuticals plc, an Oxford University biotech spinout, and Huntswood, a consulting and outsourcing business backed by 3i, where he was General Counsel and Company Secretary.
TONY WILLOUGHBY (CHAIRMAN OF EXPERTS) NOMINET
Tony qualified in 1970 and worked in the Trade Marks Department of The Distillers Company Limited (now part of Diageo) until joining Herbert Smith in 1973. He became a partner in 1977 and remained there until 1994 when he left to join Rouse & Co (now Willoughby & Partners). Tony was a partner at Willoughby & Partners until April 2006, he is now a consultant to the business. He has specialised in all aspects of intellectual property (contentious and non-contentious) since he was admitted to practice. He has had the conduct of some patent infringement actions, but most of his work has been in the field of trade marks, passing off, copyright and confidential information. He has particular experience of parallel imports/grey market and anti-counterfeiting litigation, and the Anton Piller Order and Mareva Injunction. Tony has acted in a variety of leading reported IP cases and is a panellist for the WIPO ICANN and Nominet UK domain name dispute resolution procedures. Education 1999: Attorney, sworn before the Chilean Supreme Court 1998: Passed Bar exam with honours 1997: Thesis with highest honours – Universidad Central de Chile 1992 - 1996: Universidad Central de Chile – Santiago, Chile Degree in Legal and Social Sciences Current Position with WIPO involves: Supporting the supervision of the administration of cases by Center case managers and the updating of guidelines for this purpose; assisting in the management of the roster of WIPO panelists with a view to the Center’s appointment of neutrals under a variety of domain name dispute resolution policies; contributing to the review of decisions for the Center’s online legal Index of Decisions; participating in the management and development of relations with users of the Center’s domain name services and with relevant organizations in the domain name area, including registrars; contributing to WIPO domain name dispute resolution workshops and WIPO panelists meetings; supporting the development and implementation of domain name dispute resolution policies for registry authorities and operators; undertaking legal research and drafting publications in the area of domain name dispute resolution; performing other related duties as required.
